Thank you for choosing the Crafts-n-Beer website (the “Website”), our events are sponsored by Motor City Brewing Works (the “Brewery”). By accessing or using the Website, or attending our events, you agree to comply with and be bound by these Terms of Service (“Terms”). Please read these Terms carefully. If you do not agree with any part of these Terms, please do not use the Website or attend our events.
These Terms govern your attendance at the Indie Arts & Crafts Fest event (the “Event”) and are an agreement between Crafts-n-Beer (the “Event Coordinators”), the Brewery and you. You represent to us that you are authorized to enter into these Terms.
1. Use of the Website
1.1 Eligibility: You must be at least 18 years old to use the Website and attend the Event (unless you are accompanied by a parent or guardian at all times). By using the Website, you represent and warrant that you are 18 years of age or older.
1.2 Limited License: The Website grants you a limited, revocable, non-exclusive, and non-transferable license to access and use the Website solely for the purpose of learning about the Event, purchasing tickets, registering to be crafter, and obtaining information related to the Event.
1.3 Prohibited Activities: You agree not to engage in any activity that may harm, interfere with, or disrupt the Website’s proper functioning or proceedings of the Event. Prohibited activities include but are not limited to:
a) Attempting to gain unauthorized access to the Website or any related systems or networks. b) Impersonating any individual or entity or misrepresenting your affiliation with any person or organization. c) Engaging in any form of data scraping, data mining, or data extraction. d) Violating any applicable laws, regulations, or third-party rights.
2. Intellectual Property
2.1 Ownership: All content and materials on the Website, including but not limited to text, graphics, images, logos, and trademarks, are the property of the Website or its licensors and are protected by copyright and other intellectual property laws.
2.2 Use of Content: You may not reproduce, distribute, modify, or use any content from the Website without prior written consent.
3. Your Information
3.1 If you share your information with the Event Coordinators through newsletter opt-in or ticket registration, we will use your information to send you event updates. We will retain your information for future events. Your privacy is important to us, your personal information (such as home or mailing address) will be kept strictly confidential and will not be sold, transferred or otherwise disclosed without your consent or approval. 3.2 We may share your contact information with our sponsors, if (a) you elect to attend any events or other activities involving the Event Coordinators or the Brewery or (b) you opt in during registration or otherwise to receive communications from the Event Coordinators or the Brewery.
4. Safety & Security
4.1 Your safety and security are important to us. You understand that you and your property may be searched upon entry to the Event. We reserve the right to ask you to leave the Event if your behavior causes us concern for the safety or security of event attendees.
4.2 You are responsible for your personal belongings. The Brewery and the Event Coordinators are not responsible for any loss, theft, or damage to your personal belongings during the Event. Please exercise caution and take appropriate measures to secure your possessions.
4.3 Your responsible consumption of alcohol is mandatory. If you choose to consume alcohol at the Event, please do so responsibly and in compliance with all applicable laws and regulations. The Brewery promotes responsible drinking and reserves the right to refuse service to individuals who appear to be intoxicated.
4.4 The Website and the Event are provided on an “as-is” and “as available” basis. The Event Coordinators and the Brewery make no representations or warranties of any kind, express or implied, regarding the Website or Event’s security, accuracy, completeness, reliability, or availability. Your use of the Website and attendance at the Event are at your own risk.
5. License to Use
You grant us, the Event Coordinators, the Brewery, and any representatives, volunteers and employees of the Event, the right to record, film, photograph, and capture your voice and image in any media at the Event. By attending the Event, you grant the Event Coordinator and its agents and the Brewery, a nonexclusive, royalty-free right and license to use, and distribute, for any purpose relating to our organization, the content mentioned above.
6. Assumption of Risk
You acknowledge and agree that your attendance at the Event is voluntary, and you understand the nature of the Event. To the maximum extent permitted by law, you agree that you solely assume the risks associated with attending the Event.
7. Release of Claims
To the maximum extent permitted by law, you (for yourself and anyone else who might make a claim on your behalf or as a result of damages or injury) hereby release the Event Coordinators, the Brewery, any representative of the Event and their respective directors, officers, employees, contractors, affiliates, agents, successors, volunteers and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses that you may have now or in the future associated in any way with the Event.
8. Limitations of Liability
To the maximum extent permitted by law, the Event Coordinators, the Brewery and its affiliates, partners, employees, and representatives shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or in any way related to your use of the Website or participation in the Event. THE EVENT COORDINATORS, EVENT SPONSOR, AFFILIATES AND LICENSORS WILL NOT BE LIABLE TO YOU UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR INJURIES.
9. Miscellaneous
9.1 Waiver. The failure by us to enforce any provision of these Terms will not constitute a present or future waiver of such provision nor limit our right to enforce such provision at a later time. All waivers by us must be in writing to be effective.
9.2 Assignment; No Third Party Beneficiaries. You will not assign or otherwise transfer these Terms or any of your rights and obligations under these Terms, without our prior written consent. Any assignment or transfer in violation of this section will be void. These Terms do not create any third-party beneficiary rights in any individual or entity that is not a party to these Terms.
9.3 Dispute. By agreeing to these Terms, you release any claims of dispute.
10. Event Goer Ticket Purchases and Refunds
10.1 Ticket Purchases: All ticket purchases for the Event are subject to availability and are non-transferable. By purchasing tickets, you agree to abide by any additional terms and conditions provided by the Event Coordinators or ticketing platform.
10.2 Refunds: Refunds for ticket purchases are subject to the policies set forth by the Event Coordinators or ticketing platform. Please refer to the specific refund policy applicable to your purchase.
11. Changes to the Terms
We may modify these Terms at any time by posting a revised version on the Website. The modified terms will become effective upon posting. By attending the Event after the effective date of any modifications to these Terms, you agree to be bound by the modified terms. It is your responsibility to check the Website regularly for modifications to these Terms. We last modified these Terms on the date listed at the beginning of these Terms. The Website reserves the right to update or modify these Terms at any time without prior notice. The revised Terms will be posted on this page, and your continued use of the Website or Event attendance after such changes signifies your acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Michigan, without regard to its conflict of laws principles.
